Criteria for HRT Cases

If you feel you have been injured by hormone replacement therapy (hrt) there are certain criteria that can help you evaluate whether or not you may qualify to be included in litigation.

Until recently, doctors believed the long-term use of hormone replacement therapy drugs such as Premarin, MPA (such as Provera), and Prempro were safe. Use the following guidelines to determine if you were put at risk for the following serious injuries by such treatments:

Breast Cancer: Use of Premarin and MPS together (combo use), or Prempro, for at least six months. Diagnosis must come within 2 years of stopping HRT and there must be at least one positive hormone receptor. The prescription must have been written before 2004, and the diagnosis must have been before August 1, 2004.

Ovarian Cancer: Use of Premarin and MPA, or Prempro, for a minimum of ten (10) years, or Premarin alone for a minimum of five (5) years prior to diagnosis. The prescription must have been written before 2004, and the diagnosis must have been before August 1, 2004.

Heart Attack: Use of Premarin and MPA, or Prempro, or Progesterone use only. Heart Attack must occur (1) within the first year of taking HRT, and/or (2) during or within 30 days after elective surgery where claimant left on HRT. Claimant must have been on HRT when heart attack occurred. The prescription must have been written before 2004, and the heart attack must have occurred before August 1, 2004.

Stroke (Ischemic): Use of Premairn and MPA, or Prempro, or Provera only, or Premarin only. Claimant must have been on HRT and less than 60 years old when the event occurred. Stroke must occur (1) within the first year of use and must not have prior hypertension, or (2) after any length of use, but during or within 30 days after an elective surgery where claimant left on HRT. Stroke must be ischemic and must have resulted in severe impairment or death. The prescription must have been written before 2004, and the stroke must have occurred before August 1, 2004.

Blood Clots: Deep Vein Thrombosis (DVT) and/or Pulmonary Embolism (PE): Use of Premarin and MPA, or Prempro, or Provera only. Diagnosis must occur while on HRT and claimant must continue to have residual injuries/damages. Claimant cannot have pre-existing clotting problems. The prescription must have been written before 2004, and the diagnosis must be before August 1, 2004.

Gallbladder Cancer: Use of Premarin and MPA, or Prempro, or Provera only, or Premarin only, for at least one year prior to diagnosis. The prescription must have been written before 2004, and the diagnosis must have been before August 1, 2004.
